The BN’s takeover of Perak has set off a chain-reaction of illegality which has left Perak quite possibly without a legitimate government. One of our most prosperous states has been reduced to a failed state.

One lie leads to many lies. Each bad action leads to a cascade of follies. Particularly when the lie or violation concerns something very basic. This is a principle we teach our children. It is a simple but universal truth now being demonstrated in Perak.

With each violation the sense of decency and restraint and the habits that bind us to the Constitution are loosened. The confidence in the rule of law that makes civilized life possible is diminished.

Laws are invisible things. They exist only when they are understood and observed. When the government of the day ignores foundational principles such as the separation of powers, the Constitution becomes a dead piece of paper. But the Constitution is not just any law. It is the set of laws that founds our nation, defines its basic principles, guarantees our individual rights and prescribes the structures, duties, and powers which make a national community possible. It is the foundation and source of the legal authority underlying the existence of Malaysia.

Those who so blithely ignore the Constitution for political ends are quite literally wrecking the foundations of this country to further their own interests.

This must stop.

The constitutional situation in Perak gets murkier by the day, with egos and reputations entrenched in hopeless positions. There is a simple and graceful way to clarify the situation definitively: return to the sole source of legitimate government, the will of the people as expressed through free and fair elections. Barisan might wish to show some magnanimity and confidence in calling for this.

  1. I am elated to know that at least there is still someone in UMNO knows the meaning of the rule of law. Ku Li, as a Malay who is observing from afar, please help my fellow brothers (MALAYSIANS) put a stop to this. This charade has to stop and isn’t there a single soul in UMNO that can stand up and says that something is wrong. Its no more about UMNO/BN or PKR its now clearly about what is morally (legally) right and what is wrong.

  3. I echo yuzieta – how do you stop this? How do you stop the rampant greed and corruption? The current Umno group only demonstrates that they’d prefer Mugabe-style of governance. In fact, I don’t think it’s very surprising if they use the military on the rakyat one day to force their will on the people. Tengku, isn’t there ANYTHING at all you can do?

    If there’s nothing you can do, then I can only hope for Agong to reject the appointment of Najib just like what he did in Terengganu.

    Everything has been destroyed, the police and judiciary, the MACC and the constitution to justify the ends. This is more of a personal pride battle than anything else.

    No agencies are independent. So suck is our country now. It is almost beyond repair if these leaders were to continue for another 3 months.

    Tengku, you have to move now.

    How right you are! If we bend the laws as TDM clearly did, we start down the slippery slope which leads to disaster. How far this has gone is shown by clearmalay above, who like most people is clearly surprised that there are people like you in UMNO who still belief in the rule of law.

    Yuzuita above, asks the question on most peoples mind “How to stop?”

    Sadly, we are far enough down the slippery slope that it will soon not only be a failed state but may even be the whole Country. Remember, Pakistan only started failing at the border regions.

    Let us for the moment think only for the benefit of UMNO – forget Perak and the Country for a while.

    Let us say UMNO clings on to power in Perak by any and all means. What happens 6 months, 12 months and 2 years down the tracts? Can the Government be effective? If it is, how and at what cost? What if it is not? What will the consequences be for UMNO in either case? Forget about Perak and the Country, what would happen to UMNO?

    Obviously the people so desperate and crazy for power at any cost have not thought through the effects on UMNO, far be it for Perak or the Country.

    That is why my very dear Tengku, I have urged you in several posting to move, move now, move quickly and move decisively. In urging to move decisively, I mean you have to move with “overwhelming force”.

    You can do it, you have all the right qualifications and ability. The problem for you, for which we all suffer, is that you are not prepared to cut the Gordian knot. You are only prepared to untie it, which we all know from history is impossible.

    Please forgive me for being crass but you might as well piss in the wind. When the bandits are hell bent in getting what they want, do you think they even give any considerations for the people they rape and pillage, let alone the laws of the land or any Constitution?

    They intend to hang on to power come what may. It is about immediate gratification and hang future consequences. They have done so much damage that it will take Malaysia a long time to recover. I feel almost vindicated that I emigrated and left the land of the corrupt and now the lawless. It is such a shame and they do it in the name of Islam. All they can claim is the title of “Munafiq”. They bring shame and disrepute to all right thinking Muslims.

    We need good people like yourself to take up the mantle and strike for Justice. Give me a reason to return to the land of my birth.

    You are a right minded rational individual,like the majority of right minded rational individuals in the country. However, you are a minority in UMNO – and BN, how else are we able to explain that not one single party exec of UMNO / BN has not voiced out the violation of the rule of law /separation of powers ?

    I respect your thoughts and many M’sians do, but instead of waiting for UMNO to rise to your standards, be like Dato Onn and rise to the occassion. M’sia needs leaders like you. Apologies but you can’t seem to be able to do much in UMNO, so why not leave it and be an Independent or join PR.

    I agree with jonno8888, we need people like you to voice out and lead right thinking individuals like us !~!

    I believe many in BN also not agree to what happen in Perak. But they do not dare to voice out. Those dare to voice out is just those trying to gather votes in the coming UMNO elections.

    Being a royalty yourself, can you not communicate with HRH Sultan of Perak to convey the people’s wishes for a fresh election in Perak to end the impasse? Maybe you can advise HRH to do the right thing and be remembered forever as the royalty who listens to his subject and is above politics once again. I feel rather disappointed that HRH who once commanded such high respect of the Malaysian public was ill-advised by certain selfish individual from UMNO to form a state government undemocratically and by ways of enticing dubious state assembly men and woman with promise of millions.

    I certainly do not want such an individual to be the leader who has no respect or regards for the law and constitution to be the leader of this country. A leader must gain the respect of the people and not think that he is god. A leader must respect the law and constitution of the country and not misuse the law and constitution for his own benefit or the benefit of his party.

    I certainly do not have high regards for the government of the day whose tactics in administrating law and order in this country is a keen to those of the Mafia or Triads. In short the government of the day in this country is nothing more than a legalised group of Mafias or Triads.

    Tengku, I believe it is time that you take up the challenge and bring back some dignity to this country of ours. Please do the right thing and please act fast.

    It is now up to the Sultan of Perak whether or not to accept the validity and legality of the state assembly meeting held under the raintree. Looking at it, I certainly believe that the Sultan will never recognize the meeting as he had just dismissed the ex-MB barely a month ago. Granting him (Nizar Jamaluddin) an audience would in a way asking the Sultan to eat humble pie. However it must be known that the Sultan, being a respectable Justice in the past, should have known the legality aspects of it all. The longer Perak is stuck in such a quagmire the longer the rakyat will suffer as politicians continue to lock horns with one another.

  19. If we’re in a constitutional crisis, shouldn’t the guardian of the Constitution be consulted? And it is high time. He was once consulted when the three PR ADUNs turned independent and the government in power was in question. He should be consulted again at this point. And it would be helpful if his decree gave more insights into why a certain option is chosen instead of another.

    All fellow Malaysians, CSL had just mentioned at MCA’s 60th Anniversary Grand Bash that OTK is not sincere to reconcile as a United MCA Team and all talk only without any action. NATO = STATUS QUO = NO CHANGE.

    UMNO will have it new Leadership by end of MARCH 2009 …… pending the outcome of the planned injunction by 2 UMNO members to derail the election process. There is also sentiment expressed by certain UMNO leaders for PAKLAH to continue in office as PM post March 2009. Yes Sami and kakis are also having their election in MIC come April 2009…and . NOT FORGETTING the SILENT MAJORITY of MPs and ADUNs from BN and PR…have been toeing Party’s line so far………..

    CHANGE is a CONSTANT and just let those who live in self gratification and self denial to steadfastly hang on to divide and rule concept because REAL CHANGE is more than just COSMETIC LEADERSHIP CHANGE without being ISSUES CENTERED for THE RAKYATs and MALAYSIA.

    NATO = STATUS QUO = NO CHANGE which is against 308 for CHANGE = CONFIRMED DOWNFALL.

    My dear Tengku, when UMNO was split in the middle with the formation of SEMANGAT 46, Tengku failed to CHANGE the Government then.

    Today as 1 Lone Ranger in UMNO with 1 Nomination for Presidency of UMNO made Tengku’s aspiration for CHANGE by REFORM, REINVENT, RENEW and REJUVENATE UMNO and BN enviable and doomed to failure before it starts.

    BN and UMNO could choose to remain NATO = STATUS QUO = NO CHANGE which is against 308 for CHANGE = CONFIRMED DOWNFALL.

    As THE RAKYATs had spoken for CHANGE on 308 and it is only with REAL CHANGE and NOT JUST CHANGE will ANSWER THE VOICE of 308.

    Tengku’s SPECIAL 1 position would place Tengku in pivotal position to ACTUALIZED the CHANGE failed to deliver by both UMNO/BN and PR since 308.   22. The only way out of this mess and the Perak fiasco is that there is a change in the federal government.
    Dear Tengku, are you able to convince a group of 40 MPs from BN to support you in forming a unity government with PR? Difficult and complex but not impossible. There are MPs from BN that are already fed up with the situation, and there are also those who fear Najib coming to power officially (he has, unofficially)! Work extra hard with these BN Reps and talk to the PR leadership (through the barisan rakyat leadership if need to). Convince the DYMM Agong that the people and country need immediate help out of the mess!

  23. Dear Tengku, I am so numb by all this nonsense. Most readers here are intelligent enough to know what is the right course of action to solve this problem. Give the decision back to the people to choose who should lead the state once more.

    Sometimes this is so upsetting that I believe we should allow this to happen and explode in our faces. Let this crisis explode and allow again the people to rebuild it back once more. The sad part is all the people will suffer. But I believe this suffering would give birth to a better future for the people.

    But this should not be it… Please Tengku, continue your endeavor and stay strong. Like the movie ‘The Day the Earth Stood Still’ A quote by Professor Barnhardt with the Alien Klaatu had a discussion about having the will to change, ‘Well that’s where we are. The world is a mirror reflection of our thoughts.Only when our fantasy is about to be derailed then we realised that we need to do something.Earlier when everything was good for us, we were not interested at what was happenning around us? Why the sudden care for the surrounding problems? Because we all are selfish in nature same as the war lords of UMNO , only difference we opted for very much less wealth. Accept the facts that we are selfish creature in this universe.Everyone is selfish in their own way.Who to blame? To correct this balance , many people will suffer from the financial chaos for some time. Many blame on the Bank , Government , Politician and wealthy individuals. Now we must generate ideas that the people can ask the government to give us something that we have earned.Our EPF money have used for Mega Project Financing.Now , Tengku can you help to pass a motion to help the Malaysian to use at least 15% or RM 36,000 of their EPF money to buy food for al least a year to all contributors.Be realistic . This can be achieved , lets demand what is ours.Others problems we have no way to find solution. Let find way to feed ourselves first.

    Considering all the abuse of power, the propaganda, the lies and the twisting of the law and Constitution, it reminds me of the Animal Farm by George Orwell – The pigs, who replaced the farmer that had been chased out, are becoming worse than man, and using the dogs to make sure nobody disobey, and changing the law as when they like it.

    Tengku, you should just leave UMNO, and have a national rally together with Tun Mahathir, to bring the Rakyat back to the principles set out by founding fathers.

    Only then will the Rakyat, especially those who are not net savvy, will have a chance to know the truth.

    I fully agree with you on the Perak crisis. The problem with our current UMNO leaders is that they are still dreaming. They have not understood well the message the rakyat gave them in the 2008 general elections and the following two by-elections.
    Our leaders have brought UMNO to shame by getting support from a DAP ADUN and two corrupted PKR ADUNs. Is UMNO so desperate or Najib so desperate to show that he is a capable leader?
    Taking over the Perak government through the backdoor method is not helping our party but causing more people to support the opposition. Pak Lah has to realise that Najib is not the leader the rakyat wants as PM. Go and ask anybody except his cronies, the answer will be a big “NO’ for Najib. His cronies are ready with a long list of projects and whatever they can sapu when he becomes PM. Since the rakyat does not want Najib, Pak Lah has to rethink his decision to hand over power to Najib. It will only bring disaster to UMNO. We have already performed badly in the 2008 general elections but with Najib as PM we might close shop. The few thousand supporters of Najib cannot bring back UMNO’s past glory.
    Whatever our leaders are doing has been backfiring. That goes to show the quality of leaders our party has these days. Where is our maruah when we dare not go to the polls to take over government in Perak. Tengku, you have rightly said that we must go back to the people to solve the constitutional crisis in Perak. There is no two way about it.
    It will be a test for Najib’s popularity if there is a fresh election in Perak. If he fails to take back Perak from PKR, he should resign from all posts in UMNO and the government and contest for a post in the UMNO elections if he wishes to hold any post and not by way of menang tanpa bertanding. Amalan menang tanpa bertanding yang diamalkan sejak awal 1990 telah membawa perpechan dalam party dan menyebabkan ahli-ahli serta penyokong UMNO memberi undi kepada pihak lawan dalam pilihanraya umum 2008.
    Pak Lah should postpone UMNO Assembly until a fresh election is held in Perak and only then have the UMNO Assmbly. If Najib gets back the state from the opposition, only then Pak Lah should hand over power to him otherwise the President’s post must be opened for contest by anyone and allow all UMNO members to vote. Only then we will have a strong leader and a strong party. If we are not ready for such changes, we are heading for doomsday.
    Under the present circumstances the country needs a leader like you to solve the problems faced by the people and the country and not hypocrites. More and more people are appreciating your views they read through your blog. Everywhere people are taking about you these days and not anybody else as the person who should lead the country.

  29. As a citizen, the follow-up events from the illegality cascade have left me profoundly outraged.

    Now the police wants to investigate members of the assembly for illegal assembly? What bullshit is this? The police seems to have become more powerful than the legislative branch. If we allow this to continue, there is no future for this country.

    All the law of this country has been turned upside down. Even the MACC can investigate the speaker on matters that occur within the assemby, as and when it pleases. What a sham, a joke. Clearly MACC’s role is not to protect the interest of the people, but a handful of people sitting in Putrajaya!

    What damage has been done to this country. This is going to induce more exodus of skilful citizens who are fed up with the barbaric UMNO leadership that is taking this country back into the dark ages.

    Evil men are in control of us, Ku Li!

    As I mentioned in my blog today, if UMNO leaders can think and have your insights about what is required for the Perak situation, then there is still hope for UMNO, but who is willing to change?

    If I may say it very laymanly, the people of Perak wants to vote for a government, if UMNO wants to be seen as fair and the “big brother” of all parties in Malaysia, be a man and face the situation.

    He said every Malaysian, irrespective of age, gender, social status or religion, enjoyed equal rights.

    The ruler said some Malaysians were making a big issue of the “ketuanan Melayu” issue and asking that supremacy or rights be given only to a particular race.

    “It is very unfortunate to see these self-interested parties raising sensitive issues which could dampen the spirits and hopes of millions of people. In Malaysia, every race is tuan,” he said in his speech at the launching of a seminar on the Federal Constitution here. The seminar was jointly organised by the state government and the Biro Tatanegara.

    The Raja of Perlis reminded everyone that no individual should be deprived of his rights and that sensitive issues should not be raised in a multi-racial country like Malaysia.

    “Sensitive issues and disharmony in society will only bring harm to the country,” he added.

    He said after 51 years, there was an understanding between the royal houses, leaders of all races and political parties in the country on the multi-racial character of the nation.

    “This understanding is referred to as a social contract. It is to ensure that every race lives in harmony. The rights of every individual and race cannot not be taken away and at the same time Islam will remain the official religion of the country.”

    The Raja of Perlis said the role of the Malay royalty should be upheld as they had played the most significant role in defending the rights of the people. He said it was the responsibility of the royalty to ensure that everyone lived in harmony.

    “Today, many individuals redefine the social contract in the Federal Constitution in their own narrow-minded way for personal objectives.

    “I believe that if everyone understands that every individual of any race, should not be deprived of their rights, then the efforts of certain parties who think that the supremacy or rights should only be given to a particular race can be stopped,” he said.

    The ruler hoped that the contents of the Federal Constitution will be clearly understood by all, including the leaders of political parties.

  44. From the very day of our birth, we have never really looked at ourself, our life, and our experiences in life. We have never really felt that we could create a good, decent world. Of course, some may have tried all sorts of things. You may have marched in the street in the name of the happiness of humanity, complained about the existing political system, written up new ideas and manifestos to prevent this and that— that pain, this pain, this confusion, that confusion. We may have been somewhat heroic, and we could say that we have tried our best. Nonetheless, have we found any real peace or rest? A real, dignified world has not been created.
    Often, we are so angry and resentful, and we complain because of our aggression. Instead of short hair, we want long hair. Instead of long hair, we cut our hair short. Instead of a coat and tie, we want to wear jeans and a T-shirt. Instead of this, we do that. Instead of that, we do this. We try to find some easy way to gain the freedom and the vision of human society. Instead of eating curry noodles, we try eating nasi lemak. Instead of that, we try this; instead of this, we try that. That, this, this, that. We have tried so many things. Particularly in Malaysia, people have tried so hard to reestablish a good state. I appreciate that integrity, which is quite relentless, in some sense, and pretty good.

    However, the principle of the ancient secret training is that, instead of trying so hard to remove problems, you should reestablish or plant something positive. The point is that you don’t have to take so many showers to remove the dirt. The real question is what clothes you put on after your shower and how you perfume and beautify your body. One shower is good enough; it makes you clean. Then, after that, if you continue to take showers, you become stark, too clean. There is certainly an absence of dirt, but what comes after that? There’s no warmth, no dignity. Can’t we do something more to bring reality and goodness into society?

    The point of the secret training is to get out of the cocoon, which is the shyness and aggression in which we have wrapped ourselves. When we have more aggression, we feel more fortified. We feel good, because we have more to talk about. We feel that we are the greatest author of the complaint. We write poetry about it. We express ourselves through it. Instead of constantly complaining, can’t we do something positive to help Malaysia? The more we complain, the more concrete slabs will be put on the earth. The less we complain, the more possibilities there will be of tilling the land and sowing seeds. We should feel that we can do something positive for the Malaysia instead of covering it with our aggression and complaints.

    The approach of the secret training is to do something very concrete, very basic, very definite, and to begin at the beginning. In the ancient tradition, we talk about being a warrior. I would like to make it clear that a warrior, in this case, is not someone who wages war. A true warrior is someone who is brave enough not to give in to the aggression and contradictions that exist in society. A warrior, is a brave person, a genuine person who is able to step out of the cocoon—that very comfortable cocoon that he or she is trying to sleep in.

    If you are in your cocoon, occasionally you shout your complaints, such as: “Hidup Ketuanan Melayu!” “Karpal Menghina Sultan.” “I want to be who I am.” Your cocoon is fabricated out of tremendous aggression, which comes from fighting against your environment, your parental upbringing, your educational,political party and religious upbringing, your upbringing of all kinds. You don’t really have to fight with your cocoon. You can raise your head and just take a little peek out of the cocoon. Sometimes, when you first peek your head out, you find the air a bit too fresh and cold. But still, it is good. It is the best fresh air of cool mountains or, for that matter, the best fresh air of a new freedom. So when you stick your neck out of the cocoon for the first time, you like it in spite of the discomfort of the environment. You find that it’s delightful. Then, having peeked out, you become brave enough to climb out of the cocoon. You sit on your cocoon and look around at your world. You stretch your arms, and you begin to develop your head and shoulders. The environment is friendly. It is called “planet earth.” Or it is currently called “Boleh Land” or “Malaysia.” It is your Country.

    At that point, you decide to leave your old beloved cocoon behind and to stand up without touching the cocoon at all. So you stand on your two feet, and you take a walk outside of the cocoon. Each step is rough and soft, rough and soft: rough because the exploration is still a challenge and soft because you don’t find anything trying to kill you or eat you up at all. You don’t have to defend yourself or fight any unexpected attackers or wild beasts. The world around you is so fine and beautiful that you know that you can raise yourself up as a warrior, a powerful person. You begin to feel that the world is absolutely workable, not even merely workable, but wonderful. To your surprise, you find that lots of others around you are also leaving their cocoons. You find hosts of ex-cocooners all over the place, sometimes at Malaysia Today ,Chedet, etc.

  46. Definitely Barisan wont allow fresh election. The reason is bcoz if they allowed it to be carrry out, it will be suicidal. Barisan candidates could virtually be wiped out. It will really be a disgrace for the BN leadership. So I dare say that there wont be any election at all.
